Agreement for a voluntary donation to the «EZGU AMAL» Public Foundation

«EZGU AMAL» Public Foundation (the “Foundation”), represented by its Director Rustam Norbayev, acting under the Charter, offers any individual or legal entity (the “Donor”) to enter into a donation agreement on the terms set out below (the “Offer”).

1. General provisions

1.1.In accordance with the Civil Code of the Republic of Uzbekistan, this Offer is the Foundation’s public proposal to enter into a donation agreement (the “Agreement”) on the terms below with any person who accepts it.
1.2.The Offer is accepted when the Donor transfers funds to the Foundation by any method listed on the website ezgu-amal.uz (the “Website”). By clicking “Donate” and completing the payment, the Donor confirms that they have read the terms of the Offer and accept them in full and without reservation.
1.3.The Agreement is concluded when the donation is credited to the Foundation’s account. The Agreement is deemed to be made in writing.
1.4.The Foundation may amend the Offer. A new version takes effect when it is published on the Website and does not apply to donations made before that moment.

2. Subject of the Agreement

2.1.The Donor voluntarily and free of charge transfers funds to the Foundation (the “Donation”), and the Foundation accepts them and uses them for its statutory purposes: helping children with oncological and haematological illnesses by paying for treatment, medicines, examinations and rehabilitation, and running the Foundation’s charitable programmes and projects.
2.2.If a specific fundraiser (a beneficiary, project or programme) is selected at payment, the Donation goes to that fundraiser. If the fundraiser is closed — because the required amount has been raised or help is no longer needed — the Foundation directs the funds to other beneficiaries within its statutory purposes.
2.3.A Donation made without selecting a fundraiser is used for the Foundation’s statutory purposes at its discretion, including the costs of running the Foundation within the limits set by the legislation of the Republic of Uzbekistan.
2.4.A Donation is not a payment for goods, work or services: the Foundation provides nothing to the Donor in return.

3. How donations are made

3.1.Donations are made on the Website with Visa and Mastercard bank cards, through the payment services listed on the Website, or by bank transfer to the Foundation’s account (section 9).
3.2.Donations are accepted in the national currency, the Uzbek sum (UZS). The Donor chooses the amount; the minimum is 1,000 UZS.
3.3.Card details are entered on the secure payment page of the acquiring bank or the payment service. The Foundation does not receive, process or store bank card details.
3.4.Visa and Mastercard payments are confirmed by the cardholder with 3-D Secure (Visa Secure, Mastercard Identity Check): a one-time code sent by the bank that issued the card.
3.5.To prevent fraud, the acquiring bank may decline or suspend a payment and apply the limits on amount and number of transactions set by the internet acquiring agreement. The bank that issued the card may set its own limits.
3.6.Any commission charged by a payment service is shown on the Website before the payment is confirmed.
3.7.The Donation is confirmed by an electronic receipt or another document from the bank or payment service.

4. Rights and obligations of the parties

4.1.The Foundation undertakes to use the Donation for its designated and statutory purposes, to keep records of income and expenses, and to publish reports on donations received on the Website.
4.2.The Foundation may refuse and return a Donation if there are grounds to believe the payment was made without the cardholder’s consent, with someone else’s payment details, or otherwise in breach of the law, including anti-money-laundering legislation. The Foundation reports such transactions to its servicing bank.
4.3.The Donor warrants that they are using their own bank card, or a card whose holder has consented to its use, that the funds were obtained lawfully, and that the information they provide is accurate.
4.4.The Donor may receive information on how donations are used and may request a refund of the Donation in the cases set out in section 5.

5. Refunds

5.1.A Donation is a gift, so once it is credited to the Foundation’s account it is not refunded, except in the cases listed in clause 5.2.
5.2.A Donation is refunded if: the amount was charged in error (for example, a wrong amount was entered); the payment was charged twice; the transaction was made without the cardholder’s consent; or a technical failure made the amount charged differ from the amount confirmed.
5.3.To request a refund, the Donor sends an application to info@ezgu-amal.uz within 30 calendar days of the payment. The application states the Donor’s full name, contact phone number, the date and amount of the payment, the payment method, the last 4 digits of the card or the transaction number, and the reason for the refund, with the receipt or a bank statement attached.
5.4.The Foundation reviews the application within 10 business days and reports its decision using the contact details given in the application.
5.5.Refunds are made only to the card or account the payment was made from, through the same bank or payment service. Refunds are not made in cash or to other account details.
5.6.How long refunded funds take to arrive depends on the bank that issued the card; it is usually 5 to 30 banking days.

6. Personal data

6.1.By accepting the Offer, the Donor consents to the processing of the personal data obtained when the Donation is made (name, phone number, email address, payment amount and date) to perform the Agreement, for the Foundation’s accounting and reporting, and to respond to the Donor’s enquiries.
6.2.The Foundation publishes information on donations received (date, amount, payment method, and the Donor’s name if the payment service passed it on) in the “Donations received” section of the Website. A Donor who does not want their name published can say so at info@ezgu-amal.uz.
6.3.How personal data is processed and protected is set out in the Privacy Policy published on the Website.

7. Liability and disputes

7.1.The parties are liable in accordance with the legislation of the Republic of Uzbekistan.
7.2.The Foundation is not liable for failures or delays of banks, payment systems or telecom operators, or for the actions of third parties, including scammers raising money in the Foundation’s name. The Foundation’s official account details and channels are listed on the Website in the “Beware of scammers” section.
7.3.Disputes are settled through negotiation. If a dispute is not settled within 30 days of receipt of a claim, it is referred to the court at the Foundation’s location in accordance with the legislation of the Republic of Uzbekistan.

8. Term of the Offer

8.1.The Offer takes effect when it is published on the Website and remains in force until the Foundation withdraws it.
8.2.Withdrawal or amendment of the Offer does not affect donations made before that moment.
